BPA recognises the importance of protecting the privacy of personally identifiable information collected about Their Customers.  Providing Personal Information is an act of trust and as such BPA desire their Customers to have confidence that in handling Personal Information, BPA afford that information an appropriate level of privacy, consistent with the National Privacy Principle. For the purposes of this Privacy Policy, the term Customers includes visitors to BPA’s web sites, subscribers and users of BPA’s services, and purchases of BPA’s products and services. 

Unless given consent to do otherwise, BPA will only collect and use Personal Information as set out below.

What is Personal Information?

Personal information is any information about you that identifies you, or by which your identity can reasonably be ascertained.  If the identity of a person cannot be ascertained, or can no longer be ascertained from the information, the information is not personal information.

Why is Personal Information collected by BPA?

BPA obtains personal information from its customers, suppliers and employees, or employees or officers of its customer and suppliers, for purposes relating to the conduct of its business and where required by law.  In some circumstances if BPA are unable to collect Personal Information, BPA may not be able  to service or action your request.

How does BPA collect Personal Information?

Where possible, BPA collects Personal Information directly from the Customer. This may occur through written forms and or applications, verbally over the phone or in person, or via digital communication such as email or internet interaction.  BPA’s websites may also obtain and collect personal information through use of interactive facilities such as enquiries, comment submission, forms, or competitions.  Additional BPA may obtain personal information from third parties such as BPA’s branches, agents, contractors, authorities or publicly available information (i.e. telephone directory). 

How does BPA use Personal Information?

How BPA use Personal Information depends on the reason for which it was collected.  BPA may use Personal Information for its primary purpose of collection as listed below or for any related secondary purpose that BPA could reasonably be expected to use the Personal Information for.

Primary uses of Personal Information include:

-           To fulfil obligations under any sale or purchase contract and or any other contract between the individual and BPA;

-          Responding to questions, enquiries or quotation requests regarding products, services and business;

-          To render services related to warranty or after sales service;

-          Processing applications for a trading account, credit checks, maintaining contact information, billing and statements, carrying out debt-recovery functions and administering accounts;

-          Receiving feedback and dealing with complaints;

-          Conducting marketing research, trade promotions and competitions;

-          Business planning, statistical analysis, and product development;

-          For the purposes of employment;

-          Interaction with customer via BPA’s websites;

In certain circumstances, BPA may use Personal Information for promotional or direct marketing purposes.  A person may, at any time, request BPA to cease using their Personal Information for direct marketing purposes.  Such a request can be made by contacting BPA either in writing, by email or by telephone at the contact details provided below.  There is no fee or penalty for making such a request.

Will BPA disclose Personal Information to anyone else?

BPA respects the privacy of Personal Information and will take reasonable steps to keep it strictly confidential.  However in providing Customers with a product or service, BPA may need to disclose your Personal Information to others outside of their company.   Types of organisations BPA may need to disclose your Personal Information to in the course of providing a product or service includes:

-          A person or company who is contracted to BPA to provide a particular service on their behalf;

-          Postal services, couriers or freight forwarding companies;

-          Printers of BPA’s marketing material;

-          Information technology service providers;

-          Accountants, lawyers and other service providers.

Those contracted parties are not authorised by BPA to use your Personal Information for anything other than the purpose for which it was supplied.  Additionally BPA may disclose Personal Information where the individual consents, either in writing, verbally or implied by their conduct.

Personal Information will not be disclosed for any other purposes without consent, except in exceptional circumstances when disclosure may be required by law, or is necessary to protect the rights or property of BPA, any BPA owned company, or any member of the public or to lessen a serious threat to a person’s health or safety.

How does BPA store Personal Information?

BPA may store Personal Information digitally or in hardcopy.  BPA will endeavour to take all reasonable steps to keep secure any Personal Information recorded by BPA from loss, misuse, unauthorised access or disclosure.  BPA employees are obliged to respect the confidentiality of any Personal Information held by BPA.  While restricting access to Personal Information only to staff who require it to perform their day to day functions, and maintaining technology products and policies such as identifiers, passwords, firewalls and anit-virus software are used, BPA does not however, guarantee that Personal Information cannot be accessed by unauthorised persons or that unauthorised disclosures will not occur, therefore absolute assurance that information will be secure at all times cannot be given.  BPA will not be held responsible for events arising from unauthorised access to Personal Information.

BPA will take reasonable steps to destroy or permanently de-identify Personal Information if it is no longer needed for the purposes for which BPA collected it.

Can I Review, Change, or Delete my own Personal Information?

BPA relies on the Personal Information they hold to be accurate for conducting their business, therefore it is very important that this information is accurate, complete and up to date.  BPA takes all reasonable steps to collect and hold accurate, complete and up to date information.  This means from time to time, BPA will ask you for any changes to your Personal Information.  Should you believe that your information held by BPA to be incorrect or out of date, please contact BPA immediately.

You may request to review your Personal Information held by BPA.  Such a request must be made in writing.  BPA will grant you access to your Personal Information as soon as possible, subject to the circumstances of the request.  However, a request to access personal information may be rejected if:

-          The request is frivolous or vexatious;

-          Providing access would have an unreasonable impact on the privacy of another person;

-          Providing access would pose a serious and imminent threat to the life or health of any person;

-          Providing access would prejudice BPA’s legal rights; or

-          There are other legal grounds to deny the request.

Additionally, BPA may charge a fee for reasonable costs incurred in responding to an access request.  The fee, if applicable, will be disclosed prior to it being levied.

You may request to that your Personal Information held by BPA be deleted or removed from BPA’s database or storage system.   Such a request must be made in writing.  All reasonable steps to delete or de-identify the information will be made, except where required for legal reasons.   Deletion of Personal Information may result in BPA being unable to provide sales and or services including after sales service and warranties.

What if I think my Personal Information has been compromised?
